New laws on victims of online violence<\/h2>\n

The online environment, which has become a kind of Wild West, the effect of the free and unconditional access of users, but also of the massive wave of new followers who choose to become beneficiaries of applications, creates in the digital interface an environment vulnerable not only to cyber attacks, but also to abuse, manifested in any form. If you have encountered a situation such as the one described or similar or, as a beneficiary, you consider this information necessary, this article will attempt to provide you with a small guide that will help you to understand the main concepts used, the correct understanding of the terms, how to act, the legal tool you can use and, finally, the sanction applied to the aggressor.<\/p>\n

Act No 26\/2024 on the Protection Order, under which a person who is a victim of online bullying can obtain a protection order against their abuser, brings a new notable change.<\/p>\n

The legal provisions apply to any act of online harassment, online hate messages, online stalking, online threats, non-consensual publication of intimate information and graphic content, unlawful access to private communications and data, and any other form of misuse of information and communication technology to humiliate, frighten, silence the victim.”<\/p>\n

Definition of the incriminated acts:<\/strong><\/p>\n

\"\"<\/a>The concept of “cyberstalking”<\/strong> encompasses the sum of all unlawful actions that contravene good morals and the legal limits established in the field. It therefore includes the following: threats, online stalking, sexual harassment, vulgar messages and the like, repeated online.<\/p>\n

Thus, “harassment”<\/strong> means the annoying behavior of the aggressor on the person who becomes the victim of the negative influence exerted, of the repeated action directed against him, manifested, in the case of online space, by phone calls or any kind of communication (messages, e-mail, telegram) by electronic means. Thus, a single, isolated act does not amount to cyberbullying. Importantly, the behavior of the harasser must cause the victim to fear.<\/p>\n

As far as “bullying”<\/strong> is concerned, we can recognize bullying when a person, by his or her behaviour and actions, instills a state of fear in a person. In other words, the approach of the bully is likely to alarm the victim.<\/p>\n

What is the change in the law and what can you do if you are a victim of online bullying?<\/strong><\/span><\/p>\n

Compared to the existing rules prior to the new amendment, which allowed a protection order to be obtained if there was a civil or biological relationship between the perpetrator and the victim (if they were family members or had a similar relationship: the minor to the adoptive\/ step-parent, cohabiting partners, ex-spouses), the new amendment changes this. Currently, the legislation no longer restricts the scope, so a protection order can be obtained against any perpetrator, who is prohibited from contacting the victim in any way.<\/p>\n

The new rules are valid from August 31, 2024.<\/strong><\/p>\n
