The protection order is intended to protect victims from their aggressors and can be issued by either the police or the court, depending on the urgency of the situation.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>Types of protection orders<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Provisional protection order<br>This is issued by the police for a short period of 5 days (120 hours) when there is an imminent risk to the victim&#8217;s life, physical or mental integrity, or freedom. The police officer fills out a risk assessment form and, after issuing the order, is required to inform the aggressor and monitor compliance with the measures. If there is no emergency, the victim can file a request directly with the court.<\/li>\n\n\n\n<li>Long-term protection order<br>This can be issued by the court for a maximum period of 12 months. The application is submitted to the court in the victim&#8217;s place of domicile or residence and can be made by the victim, their legal representative, the prosecutor, or other authorities and social services accredited for the protection of victims of domestic violence.<\/li>\n<\/ol>\n\n\n\n<p><strong>Definition of violence<\/strong><br>According to Law 217\/2003, domestic violence includes any intentional act of a physical, sexual, psychological, economic, social, spiritual, or cyber nature committed between family members, spouses, former spouses, or partners, regardless of whether they lived together.<br>Law 26\/2024 extends the possibility of a protection order to situations of violence that do not fall within the domestic sphere, offering the same protection for up to 12 months to other categories of persons who are not related.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>Measures ordered by the protection order<\/strong><br>The court or police may order:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the temporary removal of the aggressor from the home;<\/li>\n\n\n\n<li>the reintegration of the victim and children into the home;<\/li>\n\n\n\n<li>the aggressor to keep a minimum distance from the victim, family members, or places frequented by the victim;<\/li>\n\n\n\n<li>a ban on contact and travel to certain areas;<\/li>\n\n\n\n<li>the perpetrator to wear an electronic monitoring device;<\/li>\n\n\n\n<li>the perpetrator to surrender any weapons in their possession.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>Legal proceedings<\/strong><br>The application is heard as a matter of urgency, in chambers, with the mandatory participation of the prosecutor and legal counsel. In cases of particular urgency, the court may issue the order on the same day, without summoning the parties. The decision is immediately enforceable and is enforced under police supervision.<\/p>\n\n\n\n<p>Violation of the order constitutes a criminal offense and is punishable by imprisonment from 6 months to 5 years. After the expiration of the term, the victim may request a new order if the risk persists.
