New regulations Law no. 202/2013, amending and complementing Law no. 158/2008 on misleading advertising and comparative advertising was published in the Official Journal of Romania no. 399 of 03.07.2013.
The new regulations are mainly aimed at protecting consumers (as they are defined under Government Ordinance no. 21/1992 regarding consumers’ protection) in circumstances where the legal provisions on comparative advertising have been breached.
The National Consumers’ Protection Authority (ANPC) becomes the authority with competence to resolve consumers’ notifications about the breach of comparative advertising regime, to assess whether the relevant legal provisions have been breached and to impose administrative fines.
To this end, the new provisions expressly set forth the consumers’ right to notify the competent authorities, under the conditions of Law no. 158/2008, solely in respect of the breach of provisions on comparative advertising (but not in respect of the breach of provisions on misleading advertising).
