The law does apply only for extra muros agricultural lands in case of the following natural persons:
- Romanian citizens
- citizens of another member state of the European Union
- citizen of a member state of the EEA
- stateless persons resident in the European Union or the EEA
- legal persons having the nationality of a state member of the European Union or of the EEA
The law also assignes a pre-emption right to:
- owners
- tentants
- neighbours
- persons performing agricultural activities within the administrative area of the town where the land is located
- the Romanian state, at the same price and under the same conditions
